This Report presents the findings of ananalysis of selected organizational issues affectingcommercial justice1 performance in Bosnia and Herzegovina(BiH). It is the main deliverable under Component 1 of theBiH Commercial Justice Technical Assistance Project financedby the UK Good Governance and Investment Climate ReformTrust Fund. The Project aims to support justice institutionsin implementing reforms that improve efficiency and accessto commercial justice in BiH. The Report’s primary focus isworkload distribution among commercial courts anddepartments, and the effect of any imbalances within it ontheir performance. Other issues covered include: BiH’scaselaw database; its judicial performance evaluationsystem; production quotas and other incentive systems; itsbacklog reduction program; and court organization andmanagement. The mixed methodology used to address thesetopics combined analysis of case flow statistics provided bythe BiH High Judicial and Prosecutorial Council (HJPC) withinterviews, document review, observation, and comparative experiences.
