Pro-competition regulations in the markets for goods and services allow markets to allocate resources efficiently and achieve greater innovation, productivity, and economic growth. Perception indicators suggest that Montenegro lags in market-based competition and anti-monopoly policies compared to its aspirational peers. Fostering competition and raising productivity require adequate implementation of the right government policies that promote product market competition. This note assesses the competition framework in Montenegro by evaluating product market regulations and their enforcement, and the implemented government policies that form barriers to competition. The first section identifies sectoral, local, and economy-wide regulatory barriers to competition in product markets by screening existing regulations in Montenegro using the 2018 OECD Product Market Regulation (PMR) methodology. The second section discusses the policies that were implemented by the government which hindered competition in the area of state aid control including for SOEs, the provision of investment incentives, public procurement, and the enforcement of competition policy law. This note finds that reform progress in safeguarding free entry and fair competition among all entrepreneurs is often limited by the mandate of public institutions to enforce new laws and regulations.
